Terms and Conditions

These Terms and Conditions ("Terms") govern your use of ashleyshealingmassage.com (the "Site") and your booking or receipt of any service from Ashley's Healing Massage ("we," "us," "our," or "the Company"). By visiting the Site, submitting a booking request, or receiving a session, you ("client," "you") agree to be bound by these Terms in full. If you do not agree with any part of these Terms, please do not use the Site or book a session.

Acceptance of Terms

Booking an appointment, whether through the Site, by phone, by text, or through a third party scheduling platform, constitutes your acceptance of these Terms, along with our Service Policy, Privacy Policy, and Cancellation and Refund Policy, each of which is incorporated here by reference.

Eligibility

You must be at least 18 years of age to book a session for yourself. Sessions for a minor may only be scheduled by a parent or legal guardian, who must remain present at the service location for the entirety of the appointment and must provide written consent in advance, consistent with Section 1 of our Service Policy.

Scope of Services

Ashley's Healing Massage provides licensed massage therapy intended to support relaxation, reduce muscular tension, and promote general wellness. Our services are wellness in nature and are not a substitute for medical diagnosis, psychological treatment, chiropractic care, or physical therapy. No statement made on the Site, in marketing materials, or during a session should be interpreted as medical advice. Clients with pre-existing injuries, chronic conditions, or concerns about the appropriateness of massage therapy for their circumstances should consult a licensed physician before booking.

Health Disclosures and Client Responsibility

You are responsible for providing complete and accurate information regarding your health history, current medications, injuries, allergies, pregnancy status, and any condition that may affect your treatment, whether requested on an intake form or asked verbally by the therapist. You agree to communicate openly with the therapist during the session, including speaking up immediately if pressure, technique, or positioning causes discomfort. Withholding relevant health information may increase the risk of injury and may affect the therapist's ability to provide safe, effective care.

Assumption of Risk

You acknowledge that massage therapy, like any hands-on bodywork, carries inherent risks. These may include, without limitation, temporary soreness, bruising, tenderness, lightheadedness, or an allergic reaction to oils, lotions, or other products used during the session. By booking and receiving a session, you voluntarily assume these risks and confirm that you have disclosed all relevant health information as described in Section 4.4.

Release and Limitation of Liability

To the fullest extent permitted by Florida law, you release Ashley's Healing Massage, its owner, and any contracted practitioners from liability for claims, damages, or expenses arising from the ordinary risks of massage therapy disclosed in Section 4.5, except where such claims arise from gross negligence, recklessness, or willful misconduct on the part of the Company. Ashley's Healing Massage is not liable for indirect, incidental, special, or consequential damages of any kind arising from services provided or from use of the Site. This release does not limit any right that cannot be waived under Florida law, and nothing in this section is intended to limit liability arising from a violation of Florida Statutes Chapter 480 or other applicable licensing law.

Indemnification

You agree to indemnify and hold harmless Ashley's Healing Massage and its practitioners from any claim, loss, or expense, including reasonable attorney's fees, arising from your inaccurate health disclosures, your violation of these Terms, or your misconduct toward the therapist.

Licensing and Professional Standards

All massage therapy services are provided by a therapist licensed under Florida Statutes Chapter 480 and subject to the rules of the Florida Board of Massage Therapy. Sessions are conducted in accordance with professional draping and conduct standards required by Florida law. Any request for services outside the recognized scope of licensed massage therapy is strictly prohibited and will result in immediate termination of the session at full charge, a permanent ban from future bookings, and may be reported to the appropriate licensing authority or law enforcement, consistent with Florida's sexual misconduct provisions for massage therapy under Chapter 480.

Client Conduct and Right to Refuse Service

Clients are expected to conduct themselves respectfully and appropriately at all times. Ashley's Healing Massage reserves the right to refuse, suspend, or terminate service, without refund, to any client who behaves inappropriately, misrepresents health information, presents an unsafe environment, or otherwise violates these Terms.

Payment and Pricing

Payment is due at the time of service unless alternative arrangements have been confirmed in advance in writing. Prices listed on the Site are current at the time of publication but are subject to change without notice. Accepted payment methods are listed on the Site.

Cancellations and Refunds

All bookings are subject to the Cancellation and Refund Policy set out in Section 3 of this document, which is incorporated into these Terms by reference.

Intellectual Property

All content on the Site, including text, graphics, logos, and images, is the property of Ashley's Healing Massage unless otherwise credited, and may not be copied, reproduced, or distributed without prior written permission.

Photo, Video, and Testimonial Consent

Reviews or testimonials that a client voluntarily submits or posts publicly may be featured on the Site or on our social media accounts. We will never publish a client's photo, video, or other identifying content without that client's explicit written consent.

Website Use

You agree to use the Site only for lawful purposes and agree not to interfere with its normal operation, attempt unauthorized access to any part of the Site, or use automated means to extract content from it.

Third Party Links and Services

The Site may reference or link to third party services, including scheduling and payment platforms. Ashley's Healing Massage is not responsible for the content, policies, or practices of any third party service.

Dispute Resolution

The parties agree to first attempt to resolve any dispute arising from these Terms or from services provided informally through direct communication. If a dispute cannot be resolved informally within a reasonable time, either party may pursue any remedy available under Florida law, including in the appropriate state or county court located in Broward County, Florida.

Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with our Service Policy, Privacy Policy, and Cancellation and Refund Policy, constitute the entire agreement between you and Ashley's Healing Massage regarding your use of the Site and receipt of services, and supersede any prior understanding, whether written or verbal.

Changes to These Terms

Ashley's Healing Massage reserves the right to update these Terms at any time. The most current version will always be posted on the Site with its effective date. Continued use of the Site or booking of services after changes are posted constitutes your acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
